Freedom of expression of judges in Bosnia and Herzegovina

Freedom of expression is a fundamental human right protected by the major international rights instruments and national constitutions. The to freedom treated as one key elements democratic society it can be considered essential dignity. However, this not absolute can, if certain preconditions are met, subjected limitations, indicated provisions European Convention on Human Rights, well case law Court Rights. Judges also enjoy expression. Although participation judges in debates matters public interest very important, especially when comes regulation status judiciary, nature judicial function dictates restrictions office holders order protect confidence branch government its reputation. Public personal views may raise dilemmas regarding impartiality judge. paper will draw attention importance protecting judges, but issue necessity legitimacy restrictions. Legal regulating Bosnia Herzegovina examined, examples from practice disciplinary bodies relating exercise aforementioned right. Legislative solutions adopted compared with other countries critical evaluation.
